“Motkan,” “we,” “us,” and “our” refer to Motkan. Motkan operates as part of the broader Motkan group and builds custom AI systems and software for businesses across industries.

Motkan designs, builds, integrates, and operates custom AI systems, automation, web and mobile applications, and SaaS products — built around each client’s goals, tools, and workflows.

The website provides general information about our offerings. It is not an offer or a binding quote. Any engagement we take on is governed by a separate written agreement or statement of work, which sets out scope, fees, timelines, and responsibilities. Where that agreement conflicts with these terms, the agreement controls for that engagement.

3. Website use license

We grant you a limited, non-exclusive, non-transferable license to access and view the website for your personal or internal business use. You may not:

• Copy, modify, or create derivative works from the site except as needed to view it
• Use the materials for any unlawful purpose or unauthorized commercial exploitation

4. AI-generated output

When we operate a system on your behalf, you are responsible for how it is used and for compliance with all laws that apply to your business — including fair housing and anti-discrimination rules, advertising and consumer-protection laws, and communication and consent requirements (such as those governing email, SMS, and automated messaging). You are responsible for obtaining any consents needed to contact your leads and customers.

5. Acceptable use

You agree not to use the website or Services to:

• Send unlawful, deceptive, or unsolicited communications
• Upload malicious code or attempt to disrupt or gain unauthorized access to our systems
• Interfere with another party’s use of the Services

Ownership of deliverables and any client data is addressed in the separate agreement for each engagement. Nothing here transfers any intellectual property rights except as expressly stated.

Liability for any engagement is addressed in the applicable agreement.

11. Governing law

These terms are governed by the laws of the jurisdiction in which Motkan operates, without regard to conflict-of-laws principles, and you agree to the exclusive jurisdiction of the courts in that location.
